This agreement describes the terms and conditions applicable to the use of the website and account wagering services provided by WatchandWager.com LLC (WatchandWager). By accessing and using our website and wagering system you accept all of the terms and conditions contained herein. The use of this website is subject to all applicable State and Federal regulations. If you do not agree with these terms and conditions and legal notices, do not use this website or our wagering platform.

WatchandWager reserves the right to amend or update our terms and conditions from time to time. Account holders are encouraged to periodically review terms and conditions for updates and changes. Updated Terms and Conditions will be notified to account holders via email.

ACCOUNT ELIGIBILITY

To establish and/or maintain a wagering account, applicants must:

• Have read and agreed to abide by all Terms and Conditions set forth by WatchandWager.
  
• Be at least 21 years of age.
  
• Be resident of a state where wagering services are available.
  
• Provide the following personal information: full legal name, phone number, email address, residence address, mailing address (if different), date of birth, social security number, and any other information that may be required.
  
• Allow WatchandWager to use third party services to authenticate your account information. All information that is used to authenticate your account is kept completely confidential. WatchandWager may authenticate your information periodically until such time you notify us that you wish to close your account.
  
• Allow WatchandWager to open an advanced deposit wagering (ADW) account in your name and to manage funds on your behalf.
  
• Agree to pay any charges posted to your WatchandWager account.
  
• Notify WatchandWager immediately about any changes of address.
  
• Refrain from wagering if you relocate to any state or country that does not allow pari-mutuel wagering.
  
• Acknowledge that WatchandWager reserves the right to report unusual or suspicious activity to the proper authorities.
  

Only one account per verified person will be allowed. WatchandWager reserves the right to reject any application for an account for any reason that it deems necessary. WatchandWager also reserves the right to close an account for any reason it deems necessary. Upon closing an account, all funds in your account (less any un-wagered promotional money) will be returned to the account holder via check mailed to the registered account address within five (5) business days.

WatchandWager also reserves the right to refuse any wager and to collect any and all bank or service charges.

If an account is inactive for a period of twelve (12) months or more, WatchandWager will consider the account dormant and may charge a monthly account maintenance fee* of $5.00 or 5% of the account balance, whichever is the greater. If the account balance is $5.00 or less, the remaining balance will be assessed. The charge will not exceed the available balance in your account. 

*No dormancy fee will be assessed on any accounts held by residents of Minnesota. 

IDENTITY VERIFICATION

Under certain circumstances we may require verification of identity and/or address in order for us to comply with the terms of our Gambling License or for additional verification of your details. The following describes the acceptable documents:

1. A copy of your current unexpired passport or full driver’s license.
   
2. A copy of the front and back of your current credit/debit card(s) in use with WatchandWager.
   
3. A copy of an utility bill as proof of address. This must be less than six (6) months old; gas, electric, or bank statement will suffice. Cell phone and cable/internet bills are NOT accepted. Please note that scanned digital images work best. We can receive faxed copies, but due to low quality this can lead to delays in the verification of your details.
   

WAGERING

Account holders may place wagers through the internet or on a mobile device.. WatchandWager players may use the following phone number to check on account status and cancel wagers at any time between the hours of 12pm EST and 8pm EST seven days a week:

All telephone calls are recorded for training and quality purposes.

WatchandWager employs strict privacy and protection methods to ensure the highest level of wagering security and integrity. WatchandWager accounts may only be accessed by the registered account holder using their unique, valid login information (username, password, etc.). Account holders will be asked to verify their identity when calling our customer telephone lines.

The maximum wagering amount allowed is $2,500 (US) per transaction.  These wagering amounts are also dependent upon the racetrack and WatchandWager rules.  All wagers are commingled with the wagering pools at the host racetrack and will be subject to all host racetrack rules and restrictions.  In the case of multiple wagers such as a daily double or exacta box, the base wager is multiplied by the number of combinations to determine the amount of the total wager.  Wagers will only be accepted that do not exceed the current balance of the players’ respective wagering account.  All approved wagers will be withdrawn from the account holders wagering account prior to the submission of the wager.  Winning wagers will be credited to the account holder’s WatchandWager account upon posting of the official results by the respective host racetrack.

The amount wagered must be available in the account holder’s account.  WatchandWager does not extend credit.

WatchandWager reserves the right to refuse any wagering transaction for any reason.  Any and all wagers placed from non-wagering jurisdictions will not be accepted.

Residents of New York will not be able to place any wagers on our site on Easter Sunday or Christmas Day. 

Under certain circumstances WatchandWager may operate separate wagering pools from the host racetrack. Separate pools will be subject to rules and regulations of the applicable jurisdiction authority.

All wagers are considered final when a confirmation is received from our totalizator service provider and your wager is commingled with the host pool. If for some reason we are unable to commingle your wager with the host racetracks wagering pool, your wager will be refunded to your account.  This includes any reason that the information may have been unable to transmit to the race track including, but not limited to, mechanical, communication complications, tote and/or human error or other failure, no wager will have been placed (or deemed to have been placed) on behalf of the account holder at the racetrack the full wagered amount will be refunded to your account. 

Under no circumstances will WatchandWager “book” the wager, or otherwise be held responsible for the information not transmitted to, received by, or otherwise accepted by the racetrack.  This is not legal from any jurisdiction within the United States.

Requested wagers that are unsuccessful, ineffective or non-permissible for any reason (including any and all track errors, tote malfunction, communication failures etc.) will be canceled and the full wagered amount will be refunded to your account.

MULTIPLE “OFFICIAL” PRICES POSTED: In the event that more than one set of official prices are posted on the same event, (as a result of a miscalculation of payouts by the racetrack, an error by the state judges, or any other reason), WatchandWager will ascertain the final “official” prices from the racetrack and will make any adjustments to its account holders accounts necessary to correct any incorrect debits or credits made by WatchandWager and/or the tote provider as a result of receiving the non-final “official” prices.

LARGE FIELDS: In some circumstances runner selections in large fields may be offered as b-pool selections. These will be noted on our WagerPad as a grouped selection of runners (25-40 The Field est.)

CANCELLATIONS –You may cancel wagers online from the active portion of the bet slip by clicking the “x” WatchandWager will not accept cancellation of wagers via telephone, email or LiveChat

Use of the WatchandWager cancellation feature is subject to the following terms and conditions:

• WatchandWager account holders may request to cancel up to a maximum amount of $1000 per race day and $10,000 per month (counted as any rolling thirty (30) day period. In addition, a maximum of $250 per WPS pool and a maximum of $750 per exotic pool is permitted for wager cancellations
  
• WatchandWager may refuse to accept a wager cancellation request for any reason.
  
• WatchandWager may refuse to permit wager cancellations from any account holder for any reason.
  
• WatchandWager does not guarantee the cancellation of a wager or the availability of the wager cancellation feature.
  
• Betting pools that have already been closed will NOT be eligible for wager cancellation. 
  

New York Residents Only – Online wagering transaction cancellations are limited to $500 in Win, Place or Show Pools on any betting entry and $50 for any one combination in multiple, exotic or super-exotic pools. Wagering transaction cancellation requests for amounts over $500 on Win, Place or Show pools on any betting entry and over $50 on any one combination in multiple, exotic or super-exotic pools may be requested by contact customer service on 888 204 9150.

Cancellations that, in the opinion of WatchandWager management, may cause substantial altering of odds, prices or betting totals will be denied.

UK Thoroughbred Cancellations: Effective Monday September 11th, 2017; cancellations on GBI content will be limited to three (3) minutes from when the bet has been struck. No cancellations will be allowed after this period, any cancellation attempts will be denied.

DEPOSITS

All deposits MUST be made from a bank account, e-wallet account and/or credit or debit card in the name of the WatchandWager account holder. WatchandWager does not accept funds from a third party or business account. We reserve the right to reverse/refund any deposit that has not been made by the account holder, and may suspend the payment method used.

Deposits to your Account may be made by some, or all, of the following methods: Credit Card, Debit Card, Pre-Paid Card, Electronic Funds Transfer (EFT), Bank Wire Transfer, Cash or through third party e-wallet providers offered at WatchandWager.

Deposit limits for new accounts start at $500 daily, $1000 weekly and $5000 monthly. You can opt to have these limits increased or decreased by contacting customer service on 888 204 9150.

DEBIT/CREDIT CARD: You may use your Visa or MasterCard to fund your wagering account online. Internet gambling may be unlawful in the jurisdiction in which you are located; if so, you are not authorized to use your payment card to complete a deposit transaction. Funds from approved transactions will be made immediately available in your WatchandWager account. Cardholders should retain a copy of their transaction records and merchant policies and rules.

Please be advised that most banks will charge an additional service fee for cash advances on credit cards. Please check with your bank for any additional fees. Debit cards are not usually charged the cash advance fee but you should check with your bank to be certain. In addition, a charge of 3.25% will be applied for each card transaction.

Many card issuers (banks) restrict deposits to online wagering websites. We have found MasterCard credit cards to have better acceptance rates than Visa credit cards.

For your protection, we do not store any credit card information with your wagering account or on our site. Each transaction is processed individually through our merchant interface.

WAGERCASH (EFT): An Electronic Funds Transfer between your checking or savings account to your wagering account. This deposit method takes 5-7 business days to complete, and funds will not be made available until they have been received by WatchandWager.

Frequent users of this service may have their funds released immediately into their WatchandWager account pending receipt of funds from the issuing bank. A limit of $300 outstanding at any one time is applied to all accounts. Please contact support@watchandwager.com if you wish to increase the Wagercash deposit limit.  WatchandWager reserves the right to enforce additional restrictions and limitations at its sole discretion.

We do not charge transaction fees for using Wagercash. However, any transactions returned by your bank will be subject to a $25.00 per item service fee. Consult with your bank to find out if additional fees are imposed.

CASH (PAYNEARME): A fast and easy way to fund your wagering account starting at $5. Customers may pay cash over the counter at participating 7/Eleven, Family Dollar or CVS stores using a unique code. Once completed, funds will normally be made available in your WatchandWager account between 5-30 minutes.

Codes can be requested by text or email from the deposit section of your account. Customers will be asked to enter their email or cell number to receive the code.

PayNearMe has imposed a maximum daily deposit limit of $500.

WATCHANDWAGER PLAY+: Customers may open a Play+ account which allows them to fund their wagering account using a bank card or eCheck (Electronic Funds Transfer). Transfers from your play+ account to WatchandWager occur immediately. Enrollment to Play+ provides customers with a WatchandWager branded debit card, which can be used for goods and services anywhere Discover is accepted. Funding your Play+ account incurs a 2.95% charge, additional Play+ charges may apply a complete list of which can be found here. There is no charge for transferring funds from Play+ to WatchandWager. Minimum transfer amount is $10.00

This card is issued by Bank of George MEMBER FDIC pursuant to a license from Discover Network.  Discover® and the Discover Acceptance Mark are service marks used by Bank of George under license from Discover Financial Services. By enrolling with Play+, customers will agree to the Play+ Terms and Conditions and Privacy Policy as prescribed by the Play+ Program Agreement. 

E-WALLET: A Play+ account can be used to deposit funds into your wagering account. Funds deposited using any e-wallet will be made immediately available in your WatchandWager account.

To fund your account through a third-party e-wallet provider, the rules, deposit limits and charges of such providers will apply.  In addition, the e-wallet provider may require you to verify your account, during which time deposits may be subject to a holding period.

Only one WatchandWager account may be associated with an E-Wallet account in the same name as the WatchandWager account holder.

BANK WIRE: Deposits can be made via wire transfer; a $500 minimum transfer amount is required. Wire transfers will be funded to a player's account upon receipt of funds by WatchandWager from the issuing bank.

Any fees incurred by WatchandWager to process and receive the wire transfer will be charged to the account holder by having funds deducted from the player's WatchandWager account. If you would like to fund your account via wire transfer, please call customer service on 888 204 9150 at any time between 12:00pm to 8:00pm EST. All wire transfer transactions must be completed during regular banking hours.

WatchandWager may require further account holder identification as per banking transfer rules and regulations.

A $25 charge will be levied for any returned Check, Wagercash, E-Wallet or Card payment.

In the event of any deposit to your account being returned, refused or reversed, WatchandWager will deduct the balance from your wagering account and may suspend your account. We reserve the right to impose such conditions and restrictions as we may determine in our sole discretion prior to re-opening your Account.

Where necessary, WatchandWager may start collection procedures including, but not limited to, employing collection agencies and credit reporting agencies in an effort to collect any fees, charges or expenses incurred due to dishonored financial transactions from the responsible account holder.

WITHDRAWALS

Withdrawals will ONLY be issued to the WatchandWager named account holder.

Domestic US withdrawal requests will normally be processed within one (1) business day after receipt of the withdrawal request.  Please be aware that it may take up to five (5) business days depending upon your location for the funds to be available in your bank account.  This does not include weekends and public holidays. 

Typically, no withdrawal will be processed unless deposited funds have cleared and been verified by our financial institution. Funds must be available in the WatchandWager account. Bonuses must be wagered in their entirety prior to being withdrawn.

Domestic US withdrawals will normally always be processed in USD. Should a customer wish for the withdrawal to be processed in a different currency, they should contact customer services in writing at support@watchandwager.com. In this instance, while WatchandWager will make all reasonable efforts to obtain the best exchange rate available with its banking partners, WatchandWager accepts no liability for transactions that are processed at rates inferior to the current XE rate. 

International withdrawals will be processed in the currency that the customer has been wagering in, deemed the "Currency of Content". For example purposes; a withdrawal following wagering on UK racing will be processed in GBP, French wagering in Euro and Hong Kong wagering in HKD. Should a customer require a withdrawal in a currency other than the "Currency of Content", WatchandWager will make all reasonable efforts to obtain the best exchange rate available with its banking partners. WatchandWager accepts no liability for transactions that are processed at rates inferior to the current XE rate. WatchandWager will notify the customer of all bank transaction charges incurred in the withdrawal and this sum will be deducted from the original withdrawal request.

Withdrawal requests should be made on the website via one of the below options;

WAGERCASH:  An Electronic Funds Transfer between your checking or savings account to your wagering account. This withdrawal method normally takes 3-5 business days to complete. There are no charges to the customer for using this service. The minimum withdrawal amount is $25.00.

WATCHANDWAGER PLAY+: Customers who have enrolled with Play+ can request withdrawals back to their Play+ account. Once the withdrawal has been processed, funds are immediately available in the Play+ account. The minimum withdrawal amount for this method is $10.00. 

CHECK – Checks will be issued and mailed to the registered account holder, using the address on record. The withdrawal request will be processed by WatchandWager and mailed within three (3) business days via first class regular mail. WatchandWager does not offer an expedited mail service for this withdrawal option.

E-WALLET: Funds can be withdrawn to a Play+ account, the e-wallet account must be registered in the same name as the WatchandWager account holder. Rules and charges of such withdrawals are determined by the e-wallet provider.

We DO NOT provide refunds to credit or debit cards.

You may also request a withdrawal through player services by calling 888 204 9150 between the hours of 12pm EST and 8pm EST.  Withdrawal requests can only be made by the account holder and upon verification of the account holder’s identity.

TAX REPORTING AND WITHHOLDING

On Monday, September 25th 2017 the U.S. Treasury Department and Internal Revenue Service announced new regulations relating to the reporting and withholding of wagering proceeds. The key change of the new guidelines is the ENTIRE investment (stake) in a single pool on a single ticket shall be considered when determining the amount reported or withheld for tax purposes, as opposed to the base unit of the wager. These new guidelines help to simplify what wagers are considered reportable: any wager with proceeds over $5,000 and has proceeds which are at least 300 times as large as the amount of the wager. (For example, a $1 trifecta costing $56 will have to pay over $16,800 {56 multiplied by 300} to require any withholding or reporting). These rules will go into effect on the WatchandWager website on Friday, October 6th 2017.

If you are subject to IRS reporting and or/withholding requirements, we will send you the W2-G Form summarizing the information for tax purposes after the end of the calendar year for the previous year, less any applicable withholding, being deposited into your account.  Upon written request, we will provide you with summarized tax information on your wagering activities.

W2-G forms are submitted to the account holder only. Under no circumstances will WatchandWager split a tax reportable and/or withholding ticket between multiple players.

OFFERS AND PROMOTIONS

You may be eligible to receive offers and/or promotions from us.  Your eligibility for and the amount of these offers and promotions shall be subject to our discretion and may be based upon factors such as your location of residency, age, wagering activity and preferences, participation in bonus programs and other factors.  All offers and promotions are non-transferable.  Information regarding offers or promotions posted on our site and promotional SMS or emails sent out do not guarantee these offers or promotions will be available to all customers.  Before receiving an offer or promotion, each customer account is subject to review in order to confirm that the customer is in fact eligible to receive the offer or promotion.  Resident’s location, account status, and other criteria that WatchandWager establishes will be taken into account and verified in order to determine if your account qualifies for an offer or promotion.

If you ever receive an offer or promotion that you did not wish to receive or have applicable to you, please contact WatchandWager Customer Service before placing any bets or using funds from your WatchandWager account received as a result of such an offer or promotion.  Once the funds have been used, partially or in full, you automatically agree to the restrictions involved with said offer or promotion.

In case your account is not reflecting an offer or promotion you believe that you are entitled to receive, please contact WatchandWager customer service as soon as possible.  Certain offers and promotions are time sensitive and expire.  WatchandWager is under no obligation to honor expired offers or other promotions regardless of deposit history.

Bonus funds are not eligible for withdrawal. Cancelled wagers and wagers that trigger a minimum dividend pool will not be considered when verifying withdrawals of bonuses or associated deposits used to claim bonuses.

INDEMNIFICATION

You agree to defend, indemnify and hold harmless WatchandWager, its suppliers, distributors, contractors, subcontractors and its affiliates and related entities and their respective directors, officers, employees, and agents, from and against all claims, losses, damages, liabilities, and costs (included but not limited to reasonable attorneys’ fees and court costs), arising out of or relating to your breach of these Procedures, Terms and Conditions.  The foregoing indemnification obligation shall survive termination of these Procedures, Terms and Conditions and your purchase of any product or service provided to you by WatchandWager, its suppliers, distributors, contractors, subcontractors and its affiliates.

WARRANTIES

To the full extent permissible by applicable law, we disclaim all warranties, express, implied, or statutory, including, but not limited to, implied warranties or merchantability and fitness for a particular purpose.

NOTICE OF UNLAWFUL OR PROHIBITED USE

All account holders hereby agree to use these Services in recognition of all applicable Federal, and State laws, statutes and regulations, any deviation of which is grounds for immediate Account closure and subject to civil and/or criminal liability.

In addition, any and all activity that WatchandWager may reasonably believe to be fraudulent, deceptive, or unlawful, shall be reported to the appropriate law enforcement authorities and prosecuted to the full extent of the law.

In addition, as a condition of using our services, you warrant to WatchandWager that you will not use the WatchandWager website for any purpose that is prohibited by these terms, conditions, and notices. You may not use the WatchandWager website in any manner which could damage, disable, overburden, or impair WatchandWager. Any conduct that restricts or limits any other user's use or enjoyment of the website will not be tolerated. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the WatchandWager website. Any material which is unlawful, threatening, defamatory, invasive of privacy or publicity rights, obscene or otherwise objectionable, or which encourages conduct that would constitute a criminal offense, gives rise to civil liability or otherwise violates any law, shall not be transmitted to the website. You specifically acknowledge that WatchandWager is not liable for the defamatory, offensive or illegal conduct of other users or third parties and that the risk of injury from the foregoing rests entirely with you.

All requests for information, questions, account reconciliation, wagering discrepancies, etc., should be made to our customer services department by calling 888 204 9150.  For your protection, all telephone conversations are recorded.

THIRD PARTY WEBSITES

WatchandWager contains links to outside (third party) sites.  WatchandWager is not responsible for the privacy practices or the content of these other websites.  When clicking through to an outside (third party) site from www.watchandwager.com, please be sure you review and understand each sites’ own security and privacy policies.

PROTECTING YOUR PRIVACY

Protecting your privacy, along with financial transactions, is an essential aspect of WatchandWager’s business model.  WatchandWager does not sell, trade, or rent your information to others.  WatchandWager takes strong precautions to protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.  The Company reserves the right to make available your information to group members and affiliates where such group members are 100% owned by the company and where affiliates are 25% or more owned by it or members of the group.  Only those employees who are necessary to the client process are provided with access to your personal information.  This notice describes the type of personally identifiable information we collect and how we use such information.

TYPE OF PERSONALLY IDENTIFIABLE INFORMATION COLLECTED

We collect, retain and use information about you to protect and administer your account and funds; to comply with applicable state and federal laws and regulations and to help us design, improve and provide products and services in order to better serve you.  When you subscribe as a WatchandWager customer or when you submit a request or electronically pass information to WatchandWager, you are sometimes asked to provide certain information, such as your name, e-mail address, residential and/or mailing address, telephone numbers, social security number, birth date, credit card or bank account information.  We ask for this information to facilitate your requests, provide personalized services and communicate separately with you.  Without your written or electronic consent, we will not collect personal information over our system unless it is necessary to provide you with our services or to prevent unauthorized access to our services.

To ensure accuracy, all telephone conversations, including wagers through the Call Centre are recorded and confidentially stored.  All calls will be stored for a maximum period of 30 days after the call took place.  WatchandWager is not liable in the event of any call disputes after this (30) thirty-day period.

DISCLOSURE OF PERSONALLY IDENTIFIABLE INFORMATION

You have chosen to do business with us, and we recognize our obligation to keep the information you provide to us secure and confidential. 

YOUR RIGHTS AND RESPONSIBILITIES

Your wagering account is for your personal use and is non-transferable.  WatchandWager reserves the right to void any wagering transaction if there is reason to believe that someone other than you deposited funds in or placed a wager from your account. 

It is extremely important that you keep your account number, Personal Identification Number or Password, and other confidential account data protected and secure.  Do not share your PIN/Password or leave your computer unattended during an online wagering session. 

Please make sure that all information provided to WatchandWager is accurate and complete.  Contact us immediately at support@watchandwager.com or by calling 888 240 9150, if you find any discrepancies in your account data or if you wish to inspect our records pertaining to your account at our office.

By law, you must immediately notify us of a change in your state of residency by calling 888 204 9150.  Please note: If you move to a state where wagering services are not available, we are required by law to terminate the account and return to you all remaining funds.

We may request further proof of address if we are unable to electronically verify your current location.

RESPONSIBLE WAGERING

SELF-EXCLUSION

Individuals may choose to exclude themselves from accessing and using our site for 1 month, 6 months or 12 months by emailing support@watchandwager.com or writing to the below address. Once excluded, customers will not be able to access the account for the full duration of the exclusion.  Individuals may also exclude themselves from establishing an account with this website or all further participation in pari-mutuel wagering by requesting in writing to be permanently self-excluded. Such requests can be made to the below address or by fax or scanned document and signed by you.

This request must include the following information:

If situations should change in the future and you wish to remove yourself from the self-exclusion list, you must provide written notification of this intent to the below address. This written notification will be reviewed by this website's management prior to you being allowed to establish or re-establish an account with this website, and such determination will be made at management's sole discretion.

RETURN OF FUNDS UPON SUSPENSION OR TERMINATION

Either we or you may suspend or terminate your account at any time, either with or without cause, upon notice (we will endeavor to give such notice to you either before or after suspending or terminating your account). Please contact support@watchandwager.com if you would like to close your account.

Following termination or suspension of your account, we will, in the normal course of events, return any funds in your account to you. However, we reserve the right to withhold the funds in your account from you pending the determination of any investigation (including any relevant external investigation) where: we suspect you have acted in breach of these Terms and Conditions or any other agreement relevant to your activities on our site, including where we suspect the account has been linked with fraudulent or dishonest activity; and/or we have to withhold the funds in your account by law or to comply with any advice, request or instruction from any governmental, regulatory or enforcement authority.

In addition, if formally requested by the police, gambling regulators, taxation or other authorities or in the event that you fail to provide us with sufficient information to identify yourself in accordance with our own internal procedures or those imposed on us by regulatory authorities (wherever based) we may suspend your account and all functionality relating to the use of your account, and to withhold from you any funds in your account pending determination of any criminal or other legal proceedings or investigation to which such a request may relate or until you provide information as appropriate.

LIABILITY LIMITATIONS

Although WatchandWager diligently updates all track and wagering information periodically, in no way shall WatchandWager be liable for damages whether direct, indirect, incidental, exemplary, punitive, special or consequential, including, but not limited to loss of revenue, anticipated profits or other economic loss, whether foreseeable or not, in connection with or arising out of the availability, existence, furnishing or functioning of any services or information provided, including but not limited to omission or misstatements of track program, past performances and late changes of race information.

WatchandWager shall not be liable for any loss or damage, delay in performance or nonperformance caused by equipment malfunction or breakdown, information unavailability, strikes or other labor disputes, or riots, fire, insurrection, war, failure of carriers, the elements, accidents, acts of God, or any other causes beyond WatchandWager’s control whether or not similar to the foregoing.

The data that we (or any of our information suppliers) provide or compile generally is accurate, however occasionally errors and omissions do occur as a result of incorrect data received from others, mistakes in processing and other causes.  WatchandWager along with our data providers and suppliers, disclaim responsibility for the consequences, if any, of such errors and omissions, however notification of these errors would be greatly appreciated.

DISPUTES / COMPLAINTS

Our aim is to offer you the greatest customer experience possible, we want to hear from you so we can improve our services.

If you are not happy with the service provided you can contact us via Phone Call, livechat or Email. We will investigate and aim to reach a resolution in the first instance. A response will be sent to you within 24 hours.

If no resolution can be reached and you wish to have a second opinion, your dispute will be escalated to our Customer Service Management Team along with any supporting information/evidence. The management team will respond within 24 hours.

If you are still not satisfied, you may refer the dispute to the North Dakota Racing Commission (NDRC). The NDRC’s decision will be final (save in respect of any manifest error) subject to full representation being given to all parties involved. 

Residents of California may refer their dispute to the California Horse Racing Board 

Residents of Kentucky may refer their dispute to the Kentucky Horse Racing Commission 

Residents of Minnesota may refer their dispute to the Minnesota Racing Commission 

Residents of New York may refer their dispute to the New York State Gaming Commission 

Residents of Washington may refer their dispute to the Washington Horse Racing Commission

LIVE VIDEO AND REPLAYS

WatchandWager offers live video streaming to follow your favorite tracks online. Accounts that have not wagered a minimum $10.00 within 30 days will no longer be able to access the streaming service.

USE OF DATA PRODUCTS

Account holders shall pay for past performances and other handicapping products, per track, per day, in accordance with listed rates. Account Holders incurring charges for purchasing handicapping products can either have the cost deducted from the account holders balance, or can purchase the products separately using a valid payment method.

OTHER

Account wagering rules, policies, terms, conditions and procedures are subject to change at any time.  Changes will be posted on our website www.watchandwager.com or can be obtained by calling 888 204 9150.  It is your responsibility to be aware of all wagering rules, policies, terms, conditions, and procedures, including any changes.

The North Dakota Racing Commission (NDRC) authorizes WatchandWager.com Ltd. (owners of WatchandWager.com LLC) to operate as the Service provider for the North Dakota Simulcast System in accordance with Chapter 53-06.2 of the North Dakota Century Code and Administrative Rules of the NDRC.  WatchandWager.com License Number 2017-017.

Account holders from the USA successfully registered with WatchandWager.com LLC will be opened under the jurisdiction of the Simulcast Service Provider License from the NDRC.  All wagering and account activity from the account will be conducted under the Simulcast Service Provider License from the NDRC.

WatchandWager offers wagering on jai-alai under the jurisdiction of the Isle of Man Gambling Supervision Commission (IOM-GSC).
